The court found that the foundation was likely to succeed on the merits of its Religious Freedom Restoration Act claim.
The case adds to a patchwork of exceptions for agency enforcement of the final rule's interpretations on abortion, including other organizations and states.
The EEOC has requested a stay and argued that the foundation lacked standing, but the court found that the foundation demonstrated standing, injury-in-fact, and a threat of irreparable harm to its right of free exercise of religion.
