The Delhi High Court has ruled in favour of employees' right to receive medical reimbursement for emergency treatment, even if the hospital is not empanelled under the Central Government Health Scheme (CGHS).
The ruling came in a case involving Seema Mehta, an aided-school employee, who faced significant medical expenses after a severe accident.
The court emphasized that in emergency medical situations, immediate action is necessary and bureaucratic procedures should not compromise the survival of the patient.
The court directed the Directorate of Education (DoE) and the school authorities to reimburse the full amount of Rs 5.85 lakh to Seema Mehta within six weeks and mandated an interest payment of six percent per annum on the reimbursed amount.
