The company denied liability but agreed to pay damages, with 25% going towards back pay and the rest covering compensatory damages for individuals who were allegedly denied accommodation or terminated.
The lawsuit highlighted conflicts between Labor Department and Department of Transportation policies, with the EEOC contending that the company's employment policies violated regulations regarding reasonable accommodations for individuals with disabilities.
To resolve the case, Western Distributing agreed to delete certain policies, extend family medical leave as a reasonable accommodation, undergo compliance evaluations, and submit annual EEO reports.
