EEOC goes after its first subpoena enforcement action under the PWFA

  • The U.S. Equal Employment Opportunity Commission (EEOC) filed a lawsuit against R&L Carriers Shared Services, LLC to enforce a subpoena related to an investigation into an alleged violation of the Pregnant Workers Fairness Act (PWFA).
  • The PWFA prohibits employers from placing employees on leave when a reasonable accommodation is available for pregnancy-related limitations, unless it causes undue hardship for the company.
  • EEOC has the authority to investigate violations under Title VII of the Civil Rights Act of 1964 and the PWFA, which went into effect in 2023.
  • Under the subpoena, EEOC sought information about employees at the same location as the worker in question and drivers in several states who requested accommodations for pregnancy-related restrictions.
