Employers should regularly check E-Verify for authorization status changes, DHS warns

  • The U.S. Department of Homeland Security advises employers to use E-Verify to regularly check for authorization status changes in employees' Employment Authorization Documents.
  • DHS made information available on workers whose documents were revoked from April 9 to June 13, requiring employers to generate status change reports on the E-Verify website as case alerts will no longer be sent.
  • If an employee's authorization document is revoked, employers must reverify the employee with Form I-9, Supplement B, according to DHS.
  • DHS announced the revocation of employment authorization documents for workers whose parole has been terminated, affecting over half a million workers from Cuba, Haiti, Nicaragua, and Venezuela.

  • Chris Thomas, a partner at law firm Holland & Hart, suggests employers meet with affected employees and update their Form I-9 if they have received revocation notices.
  • Individuals without an alternative form of authorization must be terminated, as per recommendations by the law firm.
  • Employment termination, although cautious, is advised by Thomas to prevent legal consequences given that employers are deemed to be aware of the situation.
