U.S. District Court Judge Beryl Howell has ordered the reinstatement of Gwynne Wilcox to her position as a member of the National Labor Relations Board (NLRB), ruling that her firing by President Donald Trump was unlawful.
The judge characterized the firing as a "power grab" by the President and stated that he does not have the authority to terminate NLRB members at will.
Wilcox's termination was found to be in violation of the National Labor Relations Act, which allows the removal of independent board members only for neglect of duty or malfeasance in office, with notice and hearing.
The ruling reinstates a three-member quorum on the NLRB, enabling it to issue decisions once again.
