The 2024 overtime rule, which raised the threshold to $43,888 on July 1 and would have raised it to $58,656 on January 1, has been vacated by U.S. District Court Judge Sean Jordan.
It's unlikely that the U.S. Department of Labor (DOL) will appeal the decision as the outcome is unlikely to change in the conservative 5th U.S. Circuit Court of Appeals.
Employers who made classification or wage changes in July to comply with the now-reversed rule may not need to take any immediate action, as lowering salaries back down could have negative employee relations implications.
Employers can shelve plans to reclassify employees or change salaries in January, as the rule was vacated well ahead of time and organizations were likely prepared for this outcome.
