Byju’s affiliate drained cash from US units in violation of bankruptcy rules: lawsuit

  • Whitehat, a software company controlled by Byju Raveendran, apparently siphoned off nearly $700k meant to pay creditors after being placed under the control of bankruptcy attorney Claudia Springer, according to lawsuit filed at a federal court in Delaware.
  • Three other US Byju’s affiliates were also put under Springer’s management and are currently before the state’s bankruptcy court.
  • Byju’s itself is facing bankruptcy proceedings in India.
  • The move constitutes a violation of US bankruptcy rules and comes amid a larger debacle regarding Byju’s alleged hiding of $553m from its lenders, who are still pursuing the company for the lost funds.
  • Byju Raveendran has yet to respond to a request for comment.
  • Springer has launched a court case to have the money returned to her control.
  • A fraudulent transfer lawsuit has also been launched against Byju’s Alpha at a US bankruptcy court, with lenders reportedly clamouring to reclaim $533m from the company they believe should have gone to them instead.
  • Springer has asked for no funds to be transferred out of Whitehat's account while investigations continue, with the attorney alleging individuals with Byju-related email accounts in India have attempted to access the US debtor account in question.
  • Lending company Stripe and banking firm Wells Fargo have not yet responded to requests for comment on the status of the case.
