Is it legal to use a cloned or fake number plate that looks real?

  • It is an offence to use cloned or fake number plates, even if using a third party-made number plate that looks real. The use of an unauthorised plate could lead to a fine of hundreds of dollars and lead to demerit points being added onto the driver's license. In some states, there is a 10-year warranty on number plates for faulty materials or workmanship. There are rules and potential penalties across Australia for anyone found to be using unauthorised number plates. In Victoria, there is a fine of $182 and one demerit point if found in breach of the rule. Meanwhile, in NSW, the offender faces a $464 fine and three demerit points.
  • Any number plate issued to a vehicle remains the property of the State and must be surrendered to the Department of Transport and Main Roads when required, according to Queensland's transport website. Tasmania has a listed fine of up to AUD 195 for using a vehicle that is not complying with number plate/cover regulations, such as one that does not display issued plates or fails to comply with the regulation pertaining to how number plates are affixed. ACT, the subject of the article’s final mention, has one of the strictest laws on illegitimate number plates, with up to a $3,200 fine imposed for the fraudulent use of legitimately issued material.
  • If you lose a plate or it becomes illegible due to wear-and-tear, one should consult the local government website to receive a replacement plate, following the proper protocol so as to avoid any legal issues. Legally authorised plates vary from state to state, therefore check with the relevant roads authority in your state or territory.
