What employers should know now that the 2024 overtime rule is vacated
- The 2024 overtime rule, which raised the threshold to $43,888 on July 1 and would have raised it to $58,656 on January 1, has been vacated by U.S. District Court Judge Sean Jordan.
- It's unlikely that the U.S. Department of Labor (DOL) will appeal the decision as the outcome is unlikely to change in the conservative 5th U.S. Circuit Court of Appeals.
- Employers who made classification or wage changes in July to comply with the now-reversed rule may not need to take any immediate action, as lowering salaries back down could have negative employee relations implications.
- Employers can shelve plans to reclassify employees or change salaries in January, as the rule was vacated well ahead of time and organizations were likely prepared for this outcome.
